Dear Sir/Madam,

We represent Pet Friendly, Inc., of Fairhope, Alabama, with respect to intellectual property matters.

As you are obviously not aware, Pet Friendly, Inc. is engaged in the business of designing, manufacturing (or having manufactured for it), marketing and selling a plethora of pet products throughout the United States and elsewhere. They have been the exclusive supplier of rope chew toys to the largest retailer in the world for over a decade.

Because of the quality of our client’s pet products and the considerable effort expended in promoting these products, the products have met with highly favorable acceptance. In addition, the public has come to recognize our client’s products by its trademarked name and logo as a symbol of quality, service and goodwill.

Unauthorized use of the name Pet Friendly will cause the public to mistakenly assume that your business activities originate from, are sponsored by, or are in some way associated with Pet Friendly, Inc. and its valuable trademark rights.

Please be advised that using our client’s federally registered trademarked name, Pet Friendly, in any form or fashion, is strictly against state and federal law and constitutes infringement, as well as unfair competition, and violates § 43(a) of the United States Trademark Act, 15 U.S.C. § 1125(a), as constituting a “false designation of origin”.

Please cease and desist from future use of the name, Pet Friendly, on your web site and all marketing materials, effective immediately.

Having been apprised of our client’s valuable rights, we trust that you will conduct your business activities accordingly or face possible litigation.
